Apprenticeship Agreement

The following is a sample Apprenticeship Agreement

PURSUANT to the Apprenticeship and Tradesmen's Qualification Act (R.S.B.C. 1960, chap. 13) and the General Regulations contained within the text of this agreement made this ________________________, _______ by and between:

Employer / Trade Union / Joint Board:

Apprentice:

1. The employer, in consideration of the conditions herein contained, agrees
    (a) to receive the apprentice for the period stated herein and to teach efficiently the trade or occupation specified in this agreement;
    (b) to provide adequate training for the apprentice in all brances of the trade in so far as the facilities and scope of the business will permit;
    (c) to arrange for the apprentice to attend such classes in trade training and related subjects as may be prescribed by the Director of Apprenticeship and Industrial Training;
    (d) to notify the Director of Apprenticesip and Industrial Training when, for any reason, the apprentice is laid off or terminated from employment;
    (e) to co-operate with the Director, and (or) representatives, of the Apprenticeship and Industrial Training Branch in the transfer of the apprentice when circumstances warrant it; and
    (f) to the other obligations of an employer as outlined in the General Regulations Governing Apprenticeship.

2.
    (a) to place himself/herself as an apprentice in the __________________ trade / occupation for a period of ___ years, commencing on ________ and completing on _________ ;
    (b) to attend regularly such classes in trade training and related subjects as may be prescribed by the Director of Apprenticeship and Industrial Training
    (c) to incur the cancellation of the apprenticeship agreement for willful failure to attend such classes where failure could reasonably have been avoided;
    (d) to notify the director of Apprenticeship and Industrial Training when, for any reason, he/she is laid off, voluntarily leaves, or is terminated by the employer to whom he/she is indentured; and
    (e) to the other obligations of an apprentice as outlined in the General Regulations Governing Apprenticeship.

3.
    (a) that conditions relating to the period of apprenticeship and the schedule of minimum wages will be determined by the Apprenticeship and Industrial Training Branch, and that said wages shall not be less than the prevailing minimum wage, or in accordance with the prescribed scale on reverse of this Agreement, whichever is the greater; where a union scale exceeds these rates, it will take precedence;
    (b) that conditions relating to holiday pay, overtime pay, and the other benefits afforded journeymen will apply; and
    (c) that failure to attend the prescribed trade training as directed by the Director of Apprenticeship and Industrial Training will result in the termination of this agreement.

4. The employer and apprentice also agree to the transfer of this agreement to subsequent employers of the apprentice.
